Penalty Abatement
A business taxpayer may qualify for relief from penalties if there was a good faith effort to comply with the requirements of the law, but circumstances beyond your control affected timely filing and/or payment.
Penalties eligible for penalty relief include:
Failing to file a tax return
Failing to pay on time
Failing to deposit payroll taxes
Penalty relief is generally based on Reasonable Cause where all the facts and circumstances are researched and considered in providing sound arguments for the relief. The IRS specifically states that “they will consider any reason which establishes that you used all ordinary business care and prudence to meet your Federal tax obligations but were nevertheless unable to do so.” Many sound reasons, if established, proven, and well-articulated, can enter into this relief.
Offer in Compromise
An Offer in Compromise allows the client to settle personal and/or business payroll tax debt for less than the full amount owed. The process to determine eligibility for an Offer in Compromise is detailed and intimate.
Offer in Compromise may be a legitimate fresh-start option if you cannot pay your full tax liability or in doing so would create a financial hardship. It is a 12-18 month complex and arduous route to acceptance, as the IRS considers each unique set of facts and circumstances culminating in acceptance and giving you the fresh start you deserve. The OIC program, under competent guidance from an expert, has served as an important method of tax resolution since 1992. At this time, the only service we offer in this area is a self-help method of handling an Offer in Compromise.
